The rules of purchase on website www.viele.lt are a complete set of conditions valid for both you (the buyer) and Viele.lt (JSC Vielė is further treated by Viele.lt, the seller).
1. General provisions
1.1. These Rules of Purchase / Sale of Goods (hereinafter - the Rules) are a legal document binding on the Parties, which establishes the rights, obligations and responsibilities of the Buyer and the Seller, when the Buyer purchases the goods in Viele.lt web shop.
1.2. The Seller reserves the right to change, amend or supplement these rules at any time, taking into account the requirements established by law. The buyer is informed about any changes in Viele.lt website. The valid rules are always the ones, that are listed on the moment of placing the order at www.viele.lt online shop.
1.3. Who can buy goods on Viele.lt shop:
1.3.1. Persons who have reached the age of adult and whose abilities are not restricted by law;
1.3.2. Minors between the ages of 14 and 18, only with the consent of their parents or guardians, unless they can dispose of their income independently;
1.3.3. Legal entities;
1.3.4. Authorized representatives of all the persons listed above.
1.4. When approving the rules, the seller also guarantees that in accordance with 1.3. point, the Buyer has the right to buy goods in Viele.lt web store.
1.5. The Agreement between the Buyer and the Seller is considered concluded from the moment the Buyer confirms the order on viele.lt online shop.
1.6. Each contract concluded between the Buyer and the Seller is stored in Viele.lt database.
2. Privacy Policy and Protection of Personal Data
2.1. The Buyer can order the goods at Viele.lt online shop in several ways:
2.1.1. By registering and entering requested data in the web store registration form.
2.1.2. As a guest, without registration.
2.2. When Buyer buys the goods, the relevant information fields provided by the Seller must be filled. Such personal data as name, surname, exact delivery address, telephone number and e-mail are necessary to proceed and fulfill the order.
2.3. By approving these rules, the Buyer agrees, that personal data, indicated in paragraph 2.2., will be processed by Viele.lt for fulfilling the order in the online store, for Seller Performance Analysis and Direct Marketing purposes.
2.4. By accepting these rules, the Buyer agrees, that his e-mail and phone number can be used for the necessary information about his order sending.
2.5. By registering in Viele.lt online shop and/or ordering the goods, the Buyer undertakes to store and not disclose his login details to anyone.
2.6. The Buyer agrees that the personal data he voluntarily provides in the registration form will be processed in accordance with these rules.
2.7. The buyer has the right to access his personal data and to demand the correction of incomplete, inaccurate personal data, block or delete it by writing an email to info@viele.lt or by calling +37069988425. In this case, the seller must immediately comply with the buyer's request no later than within 2 working days.
2.8. The buyer has the right to receive information where and what purposes for his personal data was used, to whom it was provided or have been provided for at least the one last year.
2.9. The Data Controller acknowledges and respects the right to privacy of each Buyer who performs Registration in the online store Viele.lt (www.viele.lt). The Data Controller collects and uses the Buyer's personal data (name or surname, address, telephone number, e-mail address and other information specified in the online store registration form) to process orders for goods or services or to fulfill other contractual obligations. By placing an order or registering, the customer agrees with the rules of purchase. This also includes the sending of promotional and informational messages, if Buyer agrees to receive newsletters and similar material, which the Buyer has the full right to refuse at any time.
2.10. The Data Controller undertakes not to disclose the Buyer's personal data to third parties, except for the Data Controller's partners providing delivery of goods or other services related to the proper execution of the Buyer's order. In all other cases, the Buyer's personal data may be disclosed to third parties only in accordance with the procedure provided for by the law of the Republic of Lithuania.
2.11. Personal data is processed using secure measures to protect the data from unlawful destruction, disclosure or other unlawful acts.
2.12. Personal data, that was consented to be used for direct marketing purposes, is stored in an active database and used for 2 years for direct marketing purposes. Buyer’s data is stored for 2 years from the last purchase. After this deadline, the customer data is (automatically) destroyed. The automatic destruction of personal data is supervised by the responsible person.
3. Buyer's rights and obligations
3.1. The buyer has the right to buy goods at Viele.lt online store according these Rules and other information of this store.
3.2. The Buyer has the right to cancel purchase / sale agreement with Viele.lt online store, notifying the Seller no later than 14 days from the date of delivery except in cases when the contract can not be canceled according the rules of the law of the Republic of Lithuania.
3.3. Rules 3.2. can be applied only if the goods have not been damaged or their appearance has not substantially changed, nor has it been used.
3.4. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.
3.5. If the data provided in the Buyer's registration form changes, the Buyer must update them immediately.
3.6. The Buyer undertakes not to pass his login details to any third parties. If the Buyer loses the login data, he must immediately inform the Seller by the contacts listed in the section "Contacts" (phone / e-mail).
3.7. A person, using Viele.lt online store agrees with these Purchase and Sale Rules and undertakes to comply them and not to violate the legal acts of the Republic of Lithuania.
4. Seller's rights and obligations
4.1. The Seller undertakes to create all conditions for the Buyer to use Viele.lt online store properly.
4.2. If the Buyer tries to damage the stability and security of the operation of Viele.lt online store, the Seller has right to restrict or suspend the Buyer's access to it immediately without any notice.
4.3. The Seller undertakes to respect and secure Buyer's privacy and personal information specified in Viele.lt online store registration form.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified in the order information.
5. Orders, prices, payment procedure and terms.
5.1. www.viele.lt is an online store, accessible 24/7, unless some technical issues appears.
5.2. The Agreement enters into force from the moment when the Buyer clicks the "Confirm order" button, the Seller confirms it by sending a confirmation letter to the e-mail specified by the Buyer in the order form.
5.3. All prices in www.viele.lt online store are indicated in euros, including VAT.
5.4. The buyer can choose the payment method, listed in the order confirmation field.
5.5. The Invoice is issued after the payment is received. The paper version of such invoice is not sent together with the goods, the electronic version is sent by e-mail indicated in the order form.
6. Delivery
6.1. The goods are dispatched after the payment for the goods is received.
6.2. Delivery time in Lithuania is 1-3 working days. Please note that our delivery service may be affected over holidays and during sale periods.
6.3. Delivery in EU countries is 2-5 days, when the goods are delivered by DPD courier.
6.4. In all other cases delivery terms and prices are discussed individually and depends on country the goods are delivered to.
6.5. In all cases, the buyer must check the package. If he notices any damage to the packaging during delivery, he must indicate his remarks in the delivery document submitted by the courier or draw up a separate report on these damage. The Buyer must do this in the presence of a courier. Failure to do so shall release the Seller from liability against the Buyer for damage to the goods related to packaging damage, which the Buyer did not indicate in the courier's delivery document.
7. Quality, Guarantee and Returns
7.1. All product details are indicated the products description fields near each product.
7.2. Some features of the product may not correspond in their true color, shape or actual size due to the characteristics of the monitor used by the Buyer. The Seller is not responsible for that.
7.3. The defected goods are replaced to the good ones or can be returned to the Seller within 14 days.
7.4. If you want to cancel the order which was already paid and the goods are not received yet, please contact us by e-mail or phone number, lister in the contact field.
7.5. In all return cases the money are returned to the Buyers bank account within 7 working days after the returned item is delivered to our warehouse.
7.6. Returns and / or exchanges of defective goods are free of charge. Return of quality goods is made at the expense of the Buyer. The condition of the returned goods is checked by the Seller, if the returned goods are of good quality, the standard shipping fee is deducted from the returned amount.
7.7. The Buyer undertakes to pack the goods properly and safely. The Seller does not accept any liability for damage caused during transportation of improperly packaged returning goods.
7.8. When the Buyer returns the goods, the following conditions must be met:
7.8.1. The returned product must be in the original package;
7.8.2. The Product must be undamaged by the Buyer;
7.8.3. The product must be unused, without any loss of its commercial appearance (undamaged labels, peeled off protective film, etc.) This rule does not apply in case of return of defected product;
7.8.4. The returned product must have the same configuration as the Buyer received it;
7.9. NOTE: The return procedure does not apply to: Legal entities, products with individual customer changes on request, individual orders (such as printing) that permanently damage their original commercial appearance, goods that have been damaged by the customer, goods that do not meet the above return standards (unpacked, with marks of use and etc.) This exemption does not apply to the goods with defect of production.
8. Buyer and seller liability
8.1. The Buyer is fully responsible for the accuracy of the personal data provided on the online store. If the Buyer does not provide accurate personal data in the registration form, the Seller is not responsible for the consequences and acquires the right to claim compensation for direct losses incurred by the Buyer in such case.
8.2. The Buyer is responsible for the actions performed in www.viele.lt online store.
8.3. The registered Buyer is responsible for his login data transfer to the third parties. If a third part uses registration data of the Buyer, the Seller considers this person to be the Buyer.
8.4. The Seller is released from any liability in cases where the loss arises due to the fact that the Buyer, notwithstanding the Seller's recommendations and the Buyer's obligations, did not read these Rules, even though he was given such an opportunity.
8.5. If the Seller's online store contains links to other companies, institutions, organizations or individuals websites, the Seller is not responsible for the information or activities performed there, does not maintain, control and does not represent those companies and persons.
8.6. In the event of damage, the guilty Party shall compensate the other Party for the direct damage arised.
9. Marketing and information
9.1. The Seller may initiate various promotions.
9.2. The Seller has the right to unilaterally, without separate notice, change the terms of the promotions, as well as cancel them. Any change or cancellation of the terms and conditions of the promotions is valid from moment of their performance.
9.3. The Seller shall send all necessary notices to the Buyer by the means of communication specified in the Buyer's registration form.
9.4. The Buyer sends all notifications and questions to the Seller by e-mail or phone specified in the "Contacts" section of the store.
9.5. The Seller shall not be liable if the Buyer does not receive the sent information or confirmation messages due to internet network or e-mail service provider failures.
10. Final provisions
10.1. These Rules of Purchase / Sale of Goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.
10.2. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.
